Applying for Employment Permit in Shanghai (Change of Employers)

It’s a tedious process for foreigners applying for the Alien Employment Permit in Shanghai, be it as a new applicant, applying for an extension, changing employers, or even a change in job title. Paperwork is plenty, and unless you’re a legal representative or the like, chances are this is a yearly procedure for you. Employment Permits are only valid for a year, and your residence permit is tied to the validity of your employment permit. Lucky ones amongst us have a runner in the company’s HR who will settle everything for you, but if you’re asked to do it yourself, or if you’re between jobs but have the necessary documents to apply, then here’s a guide that will likely help you. Alternatively, you can hire an agent to settle everything for you, but why spend that 1000-2000RMB when you can do it yourself?

Please note that this guide is for those who already have an existing Alien Employment Permit and are looking to apply for a new one with a new employer. First-timers have to go through a different procedure altogether, needing a health check, and a possible trip back to Hong Kong or your home country. For a more official guide, please refer to the Shanghai Municipal Human Resources and Social Security Bureau’s Instructions for Applying for Foreigner’s Switching Employer. The following guide is from my personal experience.

Documents You Will Need:

  1. 3 passport photos (2 to be pasted on the Employment Registration Forms, 1 is for the new Alien Employment Permit)
  2. 2 completed Employment Registration Form for Foreign Employees in China (downloadable here) (You’d really want to print it out and complete it beforehand because there are no forms at the Administrative Centre, and you need your employer’s company stamp)
  3. Release letter from previous company (离职证明), and ensure that it has the company stamp
  4. Copies of your current employer’s valid Business License (营业执照), Organization Code Certificate (组织机构代码证), and Certificate of Approval (批准证书) for foreign-invested enterprises (1 copy each will be submitted at this stage, but you might want to make 2 copies as you will need to submit these to the Exit-Entry Bureau when you apply for your Residence Permit)

  5. Chinese CV, with current employer’s company stamp
  6. Reference letter with company stamp (especially if you’re working in a completely different role from your previous job, which is actually not recommended for foreigners. They take about 10 working days to process this, and there might be a higher chance of it being unapproved. Foreigners are encouraged to stay in similar work to their previous job. If your new role is similar with your previous role, then this reference letter is not needed.)
  7. Education certificates (your highest attained qualification, or certificates relevant with current job position)
  8. Copy of labour contract with current company, signed by both you and your employer, with company stamp
  9. Existing Alien Employment Permit
  10. Valid passport and residence permit (original and copy)
  11. If there are other things that is to be amended, e.g. your residential address, then you need to attach the temporary residence form that you get from the police station (派出所). The copy is acceptable, as you need to submit the original to the Exit-Entry Bureau when you apply for your Residence Permit
  12. Current employer’s User Card (用户卡), if the employer has previously applied for this card with the Administrative Centre. It looks like this:

Application Procedure:

  1. Bring these documents with you to Shanghai Administrative Center for Employment of Foreigners (上海市外国人就业中心) in the building called Shanghai Talent Center (上海人才大厦). Address: 77 Meiyuan Road, 4th floor. It’s close to Hengtong Road, and just across the street from Hanzhong Road station (汉中路), Metro Line 1, exit 2. Business Hours from Monday to Thursday: 9: 00AM-11: 30AM, 1:30PM-5:00PM. Business Hours for Friday: 9: 00AM-11: 30AM, 1: 30PM-3: 30PM. Tip: Queue numbers are still issued during lunch time.
  2. After submitting your documents, they will issue you a pink sheet of paper stating the date of collection. If there’s no issue, your Alien Employment Permit should be ready in 5 business days.
  3. On the collection day, hand over the pink sheet to the person at the Collection Counter. You will be handed a pink envelope that contains your old Alien Employment Permit (with 2 perforated holes), your new Alien Employment Permit, and one Employment Registration Form, which you will need to submit to the Exit-Entry Bureau for your Residence Permit.

You’re now ready to apply for your Residence Permit.

    The AEP is the maroon book that allows you to work legally in China, while the residence permit is the page on your passport that allows you to reside in China. The validity of the residence permit would usually be the same as the validity of your work permit.

    I'm not sure about foreign expert's certificate, but according to the official site, it's something needed by teachers? Sounds like a different thing from the AEP. I found the info here: HTTP://www.12333sh.gov.cn/2009…

    Yes you'll need to translated your education certificates/diplomas if they're not in Chinese. You can get them translated yourself, and then have your current employer's company stamp on it. I personally didn't do this myself but I called 32511585 to ask. :)

    I am holding Qingdao issued residence permit(In passport) and Alien Employment Permit (maroon booklet) both are expiring on 12 June 2011.

    Now I want to change my Employer and Province. I certainly not willing to go back to my home country(my country is amongst the 33 which can not apply Z VISA in other countries) and start the whole Z VISA procedure again. The problem is that now I have not good relationship with my current employer and he will not give me a release letter. And I don't wanna let my current employer know that I am going for this change.

    I have two companies in Shanghai and Ningbo respectively willing to hire me as their new employe and provide all required documents from their side. I also have all required documents except this painful release letter thing.

    My passport having valid residence permit and Alien Employment Permit(maroon booklet) are still in my possession.

    Now my question that is there any way I can get my alien employment permit(maroon booklet) and residence permit(in my passport) renewed on 12 june 2011. I don't care if i have to get a new alien employment permit or get the current one changed to my new company's name.

    Is there any agent out there who can help or suggest in my complex situation.

    P.S: Tried many forums but was not able to find a topic like this, Any suggesstion pertaining to current employer(Qingdao employer) is not an option.

    Hi Sinofriend,

    Sounds like quite a sticky situation. I know you said it's out of question to approach your previous employer, but getting a release letter is a must. They are obligated to provide it to you. Sue them if they refuse.

    What would a standard release letter look like? Or what wording would be included?

    If you are switching work permits between different provinces (eg Zhejiang to Shanghai), would you have to go to the labor office in one province to cancel your work permit and go to the labor office in Shanghai to transfer it? Or can you bring your still-valid-yet-about-to-expire-and-needs-to-be-renewed work permit to the Shanghai labor office to transfer and renew it per the steps mentioned above?

    I'm not sure about switching work permits between different cities/provinces, I suggest you give the bureau in Shanghai a call at 32511585.

    A typical release letter would be something like this:

    离职证明 (centralized, bold)

    [NAME],曾在 [COMPANY NAME] [DEPARTMENT] 任 [JOB TITLE],任期为 [START DATE] 到 [END DATE]。

    离职手续已办理完毕。

    特此证明!

    [COMPANY NAME]
    [DATE & COMPANY STAMP]

    This is pretty much my situation; in this case I’ve been told outright that there’s almost no chance I’ll be able to change my Employment Permit. What’s the solution? Going to Hong Kong and restarting the entire process (work permit, Z visa, etc.) as if I’d never held my previous job?

    Would it be possible for you to declare a job title similar to your previous job (as per your previous employment permit)? You just need it on the Chinese contract.

    I’m not sure if restarting the whole process would help since they would have your records?

    On the website for the Shanghai Municipal Human Resources and Security Bureau, a cancellation or transfer letter issued by the previous employment permit issuing authority is necessary to transfer work permits between different provinces.

    Hi there,

    I have a very peculiar situation!

    I worked in Guangzhou in 2007 for 6 months and had been through all the work & residence permit formalities. Post this 6 months assignment, I went back to my home country India. Again in 2011, I had another assignment in Hong Kong for an year. In 2012, I will be going to Guangzhou again for another 1 year assignment, hence, I need to know if there is any easier process for getting the work & residence permit or do I need to go through the full cycle again to get the necessary work & residence permit? In my case, I am with the same company throughout this time.

    Also, will it be alright if I go through some of the process while I am in HongKong as I have a HK ID Card and another 2 months to go.

    Your help/suggestion will be greatly appreciated. Thank in advance.

    hi, I have a question. Does the release letter have to be in Chinese? My French boss refuses to give me the letter (even though we didn’t have any conflict and I just quit peacefully), where should I go for help? He threatened that he would cancel it by himself if I don’t give the work permit back to him and that I would be in big trouble. I need the letter for making a new work permet for my new employer.

    Photocopy is good.

    But the original will be needed to be shown when you extend your residence permit.

    However, you’ll need to show the exit-entry bureau officials the originals when you extend your residence permit.

    Hi, do you know how I can obtain those ‘official’ copies? Or how about having a photocopy but stamped? My new company is not very aware of this stuff, they only gave me scanned photocopies…

    Photocopy with company stamp is sufficient for the process listed above. 

    As for the original copies for renewing your residence permit, you’ll need them from your company…
